Reduce Procedural Risk in California
Proceed helps law firms reduce avoidable delays, rejected proofs, and re-service by actively monitoring and training our servers for compliance issues and conducting expert review of proofs of service before delivery.
Steps we take to ensure the high quality of our servers:
- Verification of applicable licensing and registration requirements
- Assignment-specific instructions and special-handling guidance
- Extensive onboarding and qualification process
- Centralized monitoring of server timeliness, completion, communication, and documentation
- Where no formal licensing regime exists, we establish and document knowledge of the rules of civil procedure and conduct an annual process server awareness course
When the jurisdiction-specific proof of service is automatically generated, we conduct expert human review for completeness and compliance, as appropriate, before sending to the client.
These controls help protect case timelines while giving firms greater confidence in the accuracy and defensibility of their service documentation.
Maintain Visibility Across Every Order
Proceed’s technology gives legal teams real-time visibility into California service of process orders without relying on emails, spreadsheets, or repeated status requests.
Through the platform, firms can:
- Receive real-time updates on the serve, including attempts, completions, or if additional information is required
- View photographic documentation of completion
- Access automatically completed, jurisdiction-specific proofs of service
- Run reports on fees, final dispositions, exceptions, and escalations
As soon as you place it, your order receives a unique identifier for easy tracking.
Get Proactive Support for Difficult Serves
Incorrect addresses, evasive subjects, restricted access, and contested service can quickly consume staff time. When an order does not go as expected, Proceed’s Operations team evaluates the circumstances and recommends appropriate next steps.
Depending on the situation and applicable California requirements, options may include:
- Additional service attempts
- Address verification or skip tracing
- Stakeout or specialized service
- Re-service using updated information
- Legally permitted alternative-service strategies
- Documentation supporting a non-service outcome
If completed service is challenged, Proceed can review the proof, server notes, affidavits, photographs where available, and other supporting records to help determine the appropriate response.
Be Prepared for AB 747 Requirements
AB 747 or the SPARE Act goes into effect on January 1, 2027. The law requires timestamped, geolocated photographs of sites for attempts to serve summonses and complaints. It defines reasonable diligence as at least three good-faith attempts on different days and at different times. It also makes process server registries public, strengthens proof-of-service requirements, and adds unlawful detainer documentation requirements.
Proceed is ready to meet these requirements. Our platform workflows have built-in prompts for necessary attempts, proofs, and documentation; or our mobile app allows servers to upload timestamped photos with GPS coordinates from the field; and we regularly monitor our servers’ registration status.
